Agreement to These Terms
These Terms of Use ("Terms") govern your access to and use of the websites, landing pages, online courses, video lessons, materials, WhatsApp support, student community and any related services (together, the "Services") provided by YD ELEARNING PROGRAMS LIMITED, a private limited company registered in the Republic of Cyprus under registration number HE 498797, with its registered address at Agias Elenis 2, 6th Floor, 1060 Nicosia, Cyprus ("we", "us", "our").
By accessing the Services, creating an account, or purchasing a program, you confirm that you have read, understood and agree to be bound by these Terms, our Refund and Cancellation Policy and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide to us is accurate and complete.
Educational Purposes Only; No Financial Advice
All Services are provided for educational and informational purposes only. Nothing we provide, including lessons, examples, case studies, live or recorded sessions, WhatsApp answers, community discussions or any other content, constitutes financial, investment, trading, legal or tax advice, or a recommendation, offer or solicitation to buy or sell any security, currency, cryptocurrency, derivative or other financial instrument.
We are not a licensed investment firm, broker, portfolio manager or investment adviser. We do not provide trading signals or trade alerts, do not offer copy trading, do not manage client funds, and do not execute trades on behalf of students. You should consult a licensed financial professional before making any investment decision.
Trading and Investment Risk Disclosure
Trading and investing in financial markets, including stocks, foreign exchange, commodities, cryptocurrencies, contracts for difference and other leveraged products, involve substantial risk of loss and are not suitable for everyone. You may lose some or all of the money you invest, and leveraged products can result in losses that exceed your initial deposit. Past performance, whether actual or simulated, is not indicative of future results. Any examples, charts or historical scenarios shown in the Services are illustrative only.
You are solely responsible for your own trading and investment decisions and for any resulting gains or losses.
No Guarantees; Results Vary
We make no promise or guarantee of any financial result, income or return. The skills you develop and any outcomes you achieve depend on many factors outside our control, including your knowledge, effort, experience, capital, risk tolerance and market conditions. Any testimonials or student comments reflect individual experiences and are not typical or a guarantee of similar results.
Account Registration and Security
Some Services require you to register an account. You agree to provide accurate information, to keep your login details confidential, and to notify us promptly of any unauthorized use of your account. Your account is personal: you may not share it, transfer it, or allow any other person to access the Services through it. We may suspend access where we reasonably suspect account sharing or misuse.
Purchases, Access and Payment
The price of each program is stated on the relevant page and at checkout, including any applicable taxes. The Professional Markets Education Program is a self-paced digital course. Your purchase grants you a personal, non-exclusive, non-transferable license to access the program content for 12 months from the date of purchase, together with Q&A support via WhatsApp and access to the student community for the same period.
Payments are processed by third-party payment processors and platforms. Buy-now-pay-later, installment or financing options, where offered, are provided by third-party providers, are subject to their own terms and approval, and form a separate agreement between you and that provider. Your obligations to such a provider continue regardless of your use of the program.
Refunds and Cancellation
Our programs are digital content supplied immediately after purchase. As described in our Refund and Cancellation Policy, all sales are final and non-refundable once access has been provided, except where we are required by applicable law to offer a refund or as expressly stated in that policy. The Refund and Cancellation Policy forms part of these Terms.
Chargebacks and Payment Disputes
If you have a concern about a charge, please contact us first at yosidror12345@gmail.com so that we can try to resolve it. Initiating a chargeback or payment dispute for a purchase that was properly authorized and delivered in accordance with these Terms may result in immediate suspension of your access to the Services. We reserve the right to provide the payment processor or financing provider with evidence of your purchase, acceptance of these Terms, and use of the Services.
Intellectual Property
All content in the Services, including videos, text, worksheets, templates, graphics, logos and course structure, is owned by or licensed to YD ELEARNING PROGRAMS LIMITED and is protected by copyright and other intellectual property laws. You may use the content only for your own personal, non-commercial learning. You may not copy, record, download (except where a download function is provided), reproduce, distribute, publish, resell, share or create derivative works from any content without our prior written consent.
WhatsApp Support, Community and User Conduct
When you use WhatsApp support, the student community or any live session, you agree to behave respectfully and lawfully. You must not:
- share trading signals, trade calls or investment recommendations with other members;
- promote or solicit for any financial product, service, broker, platform or investment scheme;
- harass, threaten, abuse or discriminate against others;
- post spam, advertising or unlawful content;
- share other members' personal information or the program's content outside the community.
Answers given through WhatsApp or the community are general and educational and do not take your personal circumstances into account. We may remove content or members who breach these rules, without refund.
User Content, Testimonials and Recordings
If you submit content, such as questions, comments, reviews or testimonials, you grant us a non-exclusive, royalty-free license to use it in connection with operating and improving the Services. We will only publish your name, image or testimonial with your consent. Live sessions may be recorded and made available to students; by participating, you consent to such recording.
Third-Party Platforms and Tools
The Services may rely on or link to third-party platforms, such as course hosting platforms, payment processors, financing providers, WhatsApp, and charting or brokerage tools. We are not responsible for third-party platforms, their availability, content or terms, and your use of them is at your own risk and subject to their terms.
Prohibited Uses
You may not use the Services to break any law, infringe the rights of others, attempt to gain unauthorized access to our systems, interfere with the Services' operation, use automated tools to scrape content, or resell or redistribute access to the Services.
Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Services will be uninterrupted or error-free. Nothing in these Terms affects any statutory rights you have as a consumer that cannot be excluded by law.
Limitation of Liability
To the maximum extent permitted by law, YD ELEARNING PROGRAMS LIMITED and its directors, employees and instructors will not be liable for any trading or investment losses, loss of profits, loss of data, or any indirect, incidental, special or consequential damages arising from your use of the Services or reliance on any content. Our total liability for any claim relating to the Services is limited to the amount you paid to us for the relevant program. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold us harmless from any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Services.
Suspension and Termination
We may suspend or terminate your access to the Services, without refund, if you materially breach these Terms, including by sharing your account, redistributing content, or breaching the community rules. You may stop using the Services at any time.
Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Cyprus. The courts of Cyprus have jurisdiction over any dispute arising from these Terms, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
Changes to the Services or These Terms
We may update the Services and these Terms from time to time. The updated Terms will be posted with a new "Last updated" date. Changes will not apply retroactively to purchases already made, except where required by law.
